This is the last Will and Testament of me Thomas Lock of Hambleton in the County of Rutland Yeoman made the seventeenth day of June in the year of our Lord one thousand eight hundred and thirty six I give and bequeath unto my two friends John Palmer of Hambleton aforesaid ffarmer and John Flatt of Hambleton aforesaid Shopkeeper all my household goods and furniture plate linen and china monies and securities for money and all other my personal Estate and Effects whatsoever and wheresoever of which I may die possessed or entitled to To hold the same unto them the said John Palmer and John Flatt their Exors Admors and Assigns upon trust to convert into money such parts of my personal Estate and Effects as may not happen to consist of money and by and out of the monies which shall come to their hands in the first place to pay all my just debts funeral and testamentary expenses and in the next place to invest the net residue of the proceeds of my said personal Estate and Effects upon Government or Real securities the stocks funds or securities to be varied at discretion and pay unto or permit my dear wife Elizabeth Lock to receive the dividends interest or annual proceeds thereof when and as the same shall become due and payable for and during the term of her natural life for the maintenance and support of herself and my only child Maria Jane Lock and from and immediately after the decease of my said wife upon trust to pay or transfer the said stocks funds or securities whereon the same may be invested unto and for the only proper use and benefit of my said child Maria Jane Lock on her attaining the age of twenty one years or day of marriage which shall first happen to whom I give and bequeath the same provided nevertheless that if my said daughter Maria Jane Lock shall depart this life unmarried in the life time of my said wife or before she shall attain the age of twenty one years then I direct my said trustees and the survivor of them and the Executors and Admors of such survivor to pay over or divide or transfer one moiety of the said trust monies unto the personal representatives of my wife according to the statute for the distribution of Intestates personal Estate and Effects and to divide or transfer the other moiety of the said trust monies unto my own personal representatives according to the statute as aforesaid I appoint the said John Palmer and John Flatt Executors of this my will and declare that my said trustees and Executors and the survivor of them and the Executors and Admors of such survivor shall be charged and chargeable only for such monies as they shall respectively actually receive by virtue of this my will and that neither of them shall be answerable or accountable for any Banker Broker or other person with whom or in whose hands any part of the said trust monies shall or may be deposited lodged or intrusted for safe Custody or otherwise nor for any misfortune loss or damage which may happen to the said trust monies and premises or any part thereof in the execution of the aforesaid trusts or in relation thereto except the same shall happen by or through their or either of their wilful default respectively and that it shall and may be lawful to and for the said John Palmer and John Flatt and the survivor of them and the Executors and Admors of such survivor by and out of the trust monies which shall come to their or either of their hands by virtue of the trusts aforesaid to deduct retain and reimburse themselves and himself respectively all costs charges damages and expenses which they or either of them shall or may suffer sustain expend disburse lay out be at or put unto in or about the Execution of the aforesaid trusts or in relation thereto and hereby revoking all former wills by me made do declare this only to be my last will and Testament In witness whereof I have hereunto set my hand and seal the day and year first before written – Thomas Lock – (LS) – Signed sealed published and declared by the said Testator Thomas Lock as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses thereto the above interlineation and erasure being first made. Proved at London 19th April 1837 before the Judge by the oath of John Flatt one of the Exors to whom Admon was granted having been first sworn by Comon duly to admr – John Palmer the other Exor and one of the universal legatees in trust named in the said will having first renounced the probate and execution thereof and also the letters of Admon with the said will annexed of the goods of the said deceased –
